What Is A Contingency Fee?

In a contingency fee arrangement, a client pays ZERO up-front costs. The client only pays if the case is successful. If a money is obtained, either through a settlement or a verdict, the lawyer gets a percentage of the total recovery. Lawyers and clients use this arrangement only in cases where money is being claimed, most often in cases involving personal injury or workers’ compensation.

In this type of payment arrangement, the lawyer agrees to accept a fixed percentage of the recovery, which is the amount finally paid to the client. If you win the case, the lawyer’s fee comes out of the money awarded to you. If you lose, neither you nor the lawyer will get any money, but you will not be required to pay your attorney for the work and time spent on the case.

Advantages of a Contingency Fee

  • You do not have to pay your lawyer up front.

This gives you overall peace of mind knowing that you are not having to pay money out of pocket to cover legal bills.

  • Your lawyer does not collect a fee if the case is unsuccessful.

On a contingency fee basis, a lawyer does not earn any money unless they win your case. This gives you another ounce of peace of mind, knowing that your attorney will be fighting as hard as they can to get the outcome that you deserve, because without that, they do not earn anything either.

  • If the case is unsuccessful, you don’t pay anything.

In the chance that a case does not go your attorney’s way, you still do not owe anything.
